Welcome to Useful POS. By using our services, you agree to the following Terms of Service (ToS). Please read these terms carefully before accessing or using our website, products, and services. If you do not agree to all the terms, you may not access or use our services.

2. Definitions

  • "Company": Refers to Useful POS, its subsidiaries, and affiliates.
  • "Service": Refers to the point-of-sale system, website, and any software or services provided by Useful POS.
  • "User" or "You": Refers to any person or entity using our Service.
  • "Agreement": Refers to these Terms of Service.

3. Acceptance of Terms

By accessing and using Useful POS, you confirm that you are legally capable of entering into this agreement and agree to be bound by these terms. If you are using our services on behalf of a company, you represent that you have the authority to bind that company to these terms.

4. Changes to Terms

We reserve the right to modify these terms at any time. You will be notified of any changes via email or through our website. Your continued use of the Service after such changes will constitute your consent to the updated terms.

5. Service Usage

Useful POS provides businesses with point-of-sale software, online ordering systems, and other tools to manage sales and operations. By using our Service, you agree to:

  • Use the Service only for lawful purposes.
  • Provide accurate, current, and complete information when required.
  • Not interfere with or disrupt the Service or the servers or networks connected to the Service.

We reserve the right to terminate accounts or refuse access to the Service if we believe you are violating these terms.

6. Subscription and Payment Terms

Useful POS operates on a subscription basis. By subscribing to our Service, you agree to the following terms:

  • Pricing: The standard subscription fee is £300 per month, with a minimum six-month contract. Hardware costs are separate and are to be paid by the client.
  • Billing: Payments are processed monthly in advance. If a payment is missed or late, we reserve the right to suspend or terminate your access to the Service.
  • Renewals: After the initial six-month contract, your subscription will automatically renew on a monthly basis unless canceled.

7. Hardware Purchases

If you purchase hardware through Useful POS, you agree to:

  • Be responsible for all hardware payments.
  • Acknowledge that hardware is sold as-is, with warranty information provided by the respective manufacturer. Useful POS is not responsible for hardware failures beyond the warranty period.

8. Termination

Either party may terminate this agreement with 30 days’ notice. If you terminate before the end of the six-month contract, you will still be responsible for the remaining subscription fees. Useful POS may terminate or suspend access to the Service immediately for any breach of these terms without prior notice.

9. Data Ownership and Privacy

Useful POS respects your privacy and complies with data protection regulations. We collect and use data as described in our Privacy Policy. By using our Service, you consent to the collection and use of your data in accordance with our Privacy Policy.

10. Limitation of Liability

Useful POS is not liable for any indirect, incidental, or consequential damages resulting from the use of our Service, including but not limited to loss of profits, data, or business opportunities. Our total liability to you for any claim related to the Service is limited to the amount paid by you for the Service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Useful POS, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debts arising from your use of the Service or violation of these terms.

12. Governing Law

These Terms of Service are governed by the laws of the United Kingdom. Any disputes arising out of or relating to these terms will be resolved exclusively by the courts located within the United Kingdom.
